The hearing to evaluate the possibility of resentencing Erik and Lyle Menéndezsentenced to life imprisonment for the murder from his parents in 1989, has been postponed to January 30 and 31after an agenda change decided during a status conference on Monday in Los Angeles.
The judge in charge rescheduled the date originally scheduled for December 11. Relatives of the brothers attended the hearing and offered testimony on their behalf. Erik and Lyle Menendez participated in the session remotely from the Donovan Correctional Facility in Otay Mesa, although they did not issue statements. The hearing began at 10:30 am and concluded around noon. No cameras were allowed or live streaming of the proceedings.
The court held a lottery to allocate 16 seats available to the public, and attendees were required to place their cell phones in plastic bags during the event.
The defense attorney filed a habeas corpus petition 18 months ago after discovering a letter written by Erik to a cousin before the murders, in which he discussed sexual abuse by his father and expressed fear of him.
Additionally, a former member of the band Menudo recently claimed that José Menéndez, who was an executive at RCA Records, had also sexually abused him.
In October, Los Angeles District Attorney George Gascón filed a request for a judge to consider resentencing the brothers. However, less than two weeks later, Gascón lost his re-election bid to Nathan Hochman, who will take office on December 2 and has promised to review the case before issuing his recommendation.
